Terms & Conditions — Defteng NZ

1. Services

Defteng ("we", "us") provides remote structural and architectural engineering services for New Zealand clients. Services include structural design, engineering drawings, building consent documentation, and Producer Statement PS1 (Design). Services are confirmed via written agreement or accepted quote.

2. Scope of PS1 (Design)

Our PS1 (Design) certifies that the structural design prepared by Defteng complies with the New Zealand Building Code and the NZ Standards referenced in the design. It does not cover construction work, site supervision, or any work outside the scope of the issued design documents. We provide PS1 (Design) only — not PS3 or PS4.

3. Client Responsibilities

The client is responsible for providing accurate site information (including site address, soil type, topography, and existing structures), ensuring the engineering information is correctly incorporated into the building consent application, and engaging other consultants (e.g. geotechnical, fire) as required by their Territorial Authority.

4. Payment

Fees are agreed in advance via written quote. Payment terms are stated on each invoice (typically 14 days). We reserve the right to withhold delivery of final documents until payment is received. Late payments may incur interest at 2% per month.

5. Intellectual Property

All engineering calculations, drawings, and documents remain the intellectual property of Defteng until full payment is received. Upon full payment, the client receives a licence to use the documents for the specific project described in the agreed scope.

6. Limitation of Liability

Our liability is limited to the fee paid for the specific service. We are not liable for consequential losses arising from delays in consent processing, errors introduced during construction, or changes to site conditions not communicated to us. Our engineering liability is covered by professional indemnity insurance.

7. Amendments

Any changes to scope, site conditions, or design after issue of the initial documents may be subject to additional fees. We will advise in writing before proceeding with any additional work.

8. Governing Law

These terms are governed by New Zealand law. Any dispute will be resolved by negotiation in good faith; if unresolved, by mediation or arbitration under New Zealand law.
